Abstract
Titularidad de la Propiedad Industrial e Intelectual en México realizada bajo una relación de trabajo o por encargo

RESUMEN: Es claro que en México no prima una cultura de protección en materia de Propiedad Intelectual. En efecto, la generalidad de los inventores y autores mexicanos antes de proteger legalmente sus inventos u obras, las comercializan o dan a conocer públicamente, lo que puede acarrear la pérdida de la exclusividad -en el caso de los inventos- o incluso que terceros sin escrúpulos obtengan la protección legal en su favor y en detrimento de los legítimos inventores o autores.
Adicionalmente, existe desconocimiento sobre la titularidad de la Propiedad Industrial e Intelectual de productos o servicios realizados bajo una relación laboral, o bien, por encargo de un tercero (sin subordinación).
El presente trabajo se aboca a analizar diversos casos de titularidad de las principales figuras de la Propiedad Industrial e Intelectual en los supuestos mencionados en el párrafo anterior.

ABSTRACT: It is clear that in Mexico there is not a culture of protection regarding intellectual property. In fact, most of the Mexican inventors and authors, prior to legally protecting their inventions or work, commercialize or advertise their work. Such action may cause the loss of exclusivity regarding inventions, including the abuse by a third party who may obtain legal protection in its favor and to the detriment of the legitimate inventors or authors.
In addition, there is a lack of knowledge in regards to the ownership of the intellectual property of products or services performed under an employment relationship, or commissioned by a third party (without subordination).
The following document aims to analyze diverse ownership cases of the industrial and intellectual property as mentioned in the previous paragraph.
