Abstract

Los Retos del Juzgador Administrativo ante la Globalización

RESUMEN: En el artículo se identifica cómo la globalización ha impactado la función del juzgador administrativo, señalándose algunos temas en donde el reto para el juzgador administrativo se presenta con mayor claridad, cuya atención exige realizar esfuerzos de reflexión prospectiva frente a una realidad que cambia drásticamente sin seguir modelos previos; y que son: i) internacionalización del derecho, ya que cada día es más común resolver controversias administrativas aplicando derecho internacional; ii) la formación del juzgador administrativo, que al no ser un juez ordinario merece especialización continua; iii) la aplicación de las medidas cautelares, cuya eficacia salvaguarda incluso el prestigio de la impartición de justicia; iv) la transparencia en la función jurisdiccional, que no se limita a la publicidad de las decisiones jurisdiccionales, sino que incluye el manejo de las instituciones judiciales y su presupuesto; v) la tecnología como instrumento de eficiencia, que exige el abandono de paradigmas.

The Challenges of Globalization for the Administrative Judge

ABSTRACT: In this article, the author identifies the impact of globalization on the functions of an administrative judge, mentioning issues that illustrate more clearly the challenges that he or she faces. Prospective efforts of reflection are necessary in a world that changes drastically, where it is impossible to follow previous models; these include: 1.) The internationalization of law, taking into account that solving administrative controversies through the application of international law is more common everyday; 2.) The continuous training of an international judge, who should receive continuous specialized training because he is not an ordinary judge; 3.) The application of preventive measures, whose effectiveness can even safeguard the prestige of administering justice; 4.) Transparency in jurisdictional services, which is not limited to the publicity of the jurisdictional decisions, but also includes the management of judicial institutions and their respective budgets; 5.) Technology as a tool of efficiency which demands the abandonment of paradigms.

*N del T: Though the term magistrate is not equivalent, since it does not have the same connotation as in the U.S.; whereas in Mexico a magistrado is a high-ranking judicial officer who most probably has already serve as a trial judge, in the U.S. a magistrate is a lower-ranking judicial officer, such as justice of the peace who has many but not all the powers and duties of a regular judge and who is appointed by judges of federal courts
