Abstract

Teoría de la Nulidad del Acto Administrativo

RESUMEN: El Estado lleva a cabo sus fines a través de acciones que realiza la Administración Pública; en la actualidad, estas acciones se han multiplicado ya que el Estado ha adquirido injerencia en un sinnúmero de actividades que deben sujetarse a la ley. Desafortunadamente, en ocasiones es la propia autoridad la que infringe el ordenamiento jurídico, por lo que se imponen límites a las actividades del Estado a través del control de la legalidad, el cual se aplica a través los recursos administrativos que se interponen ante la misma Autoridad Administrativa, o ante el Tribunal Federal de Justicia Fiscal y Administrativa por medio del juicio contencioso administrativo, en el se declara la nulidad o la validez del acto. Se sugiere la organización de un sistema general en el que precise con toda claridad en qué casos procede la declaración de la nulidad lisa y llana y cuándo será para efectos, pues esto daría seguridad jurídica a las partes y provocaría que el planteamiento de los argumentos de las demandas fueran específicos y ayudaría a que el criterio del Tribunal, fuese uniforme.

Theory of the Administrative Act’s Nullity

ABSTRACT: The objectives of the State are carried out through the Public Administration’s proceedings; nowadays these actions have multiplied because the State has gained interference in innumerable undertakings that must be subjected to the law. Unfortunately, sometimes authorities themselves infringe the juridical order; therefore, limits are imposed on the State’s undertakings through the control of legality, which is applied by means of the administrative resources that are interposed before the Administrative Authority, or the Federal Tax and Administrative Court (Tribunal Federal de Justicia Fiscal y Administrativa) through a litigious administrative judgment, where the nullity or validity of the act is declared. The organization of a general system that defines with clarity in which cases the declaration of pure and simple nullity proceeds, and when it will be used for such purposes, is suggested; this would provide judicial security to the respective parties, resulting in specific arguments approaches, and it would help the Court’s criteria to be standardized.
