RESUMEN: Existe desde hace unos años una gran inquietud en la revisión de los alcances y efectos de las sentencias. En esta oportunidad destacaremos que las sentencias son el acto más importante de la función jurisdiccional, toda vez que éstas sin lugar a dudas, son el medio por el cual los órganos jurisdiccionales se legitiman y ponen fin a una controversia en concreto. Una sentencia consiste en aplicar y declarar el derecho al caso sometido a la consideración de los órganos estatales encargados de la misma, los cuales deben conseguir un equilibrio entre las garantías, tanto de los derechos e intereses públicos y privados en juego, así como del acierto y calidad de las decisiones judiciales, emitidas con la celeridad de los procesos y la efectividad de lo juzgado. Bajo este marco, el ensayo que se presenta tiene la finalidad de aportar un acercamiento a una sistematización filosófico jurídico en el estudio de la sentencia.

ABSTRACT: There is from a few years ago a great concern in the review of the scope and effects of judgments. In this opportunity we will be highlighting that sentences are the most important act of the judicial function, since these without any doubt, are the means by which courts legitimize and put an end to a dispute in particular. A sentence is to apply and declare the right to the case submitted to the consideration of the State bodies responsible for the same, which must strike a balance between safeguards, both rights and public and private interests at stake, as well as the success and quality of judicial decisions, issued with the speed of processes and the effectiveness of the Court. Under this framework, the essay that is presented has the purpose of providing a philosophical approach to a systematic legal in the study of the judgment.
